Q1 Who comprises  the Internal Complaints Committee mentioned under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013? 2M

Answer:

Acc to Section 4 of the Act, the Internal Committees shall consist of the following members to be nominated by the employer, namely: —

  • a Presiding Officer who shall be a woman employed at a senior level at workplace;
  • not less than two Members from amongst employees preferably committed to the cause of women or who have had experience in social work or have legal knowledge;
  • one member from amongst non-governmental organisations or associations committed to the cause of women or a person familiar with the issues relating to sexual harassment.

Provided that at least one-half of the total Members so nominated shall be women

Q2 Define the terms Khewat and Khtauni. 2M

Answer:

According to Rajasthan Land Revenue Act, 1956

Khewat– a register of all estate-holders in the area under survey and record operations or under record operations, specifying the nature and extent of the interest of each and his co-sharers, mortgages in possession and persons holding land from him otherwise than as tenants, if any. (114 a)

Khatauni is a register of all persons cultivating or otherwise holding or occupying land in such area, specifying the particulars required by section 121.

Q3 What is ‘Aggrevated Penetrative sexual assault ‘ under the POCSO Act? 5M

Answer:

Section 5 of The POCSO Act defines certain actions as “aggravated penetrative sexual assault” in 20 categories 

  • These include cases when a police officer, a member of the armed forces, or a public servant commits penetrative sexual assault on a child. 
  •  It also covers cases where the offender is a relative of the child, or if the assault injures the sexual organs of the child or the child becomes pregnant, among others. 
  • The POCSO Amendment Act 2019, adds two more grounds to the definition of aggravated penetrative sexual assault-  (i) assault resulting in death of child, and (ii) assault committed during a natural calamity, or in any similar situations of violence. 

Section 6 of the Protection of Children from Sexual Offences Act (POCSO) of 2012 prescribes a minimum of 20 years in rigorous imprisonment for aggravated penetrative sexual assault, which can extend to life imprisonment or death penalty. The offender is also liable to pay a fine to the victim to cover medical expenses and rehabilitation

Q4 Under what conditions the interests of the tenant in his holding shall be extinguished ? 5M

Answer:

The interest of tenant in his holding or a part thereof shall be extinguished, as per the provisions of Tenancy Act 1955, 

(i) When he dies leaving no heir entitled to merit

(ii) when he surrenders or abandons it 

(iii) when his land has been acquired under the Land Acquisition Act. 1894 

(iv) when he has been deprived of possession and his right to recover possession is barred by limitation

(v) when he has been ejected therefrom 

(vi) when he acquires or succeeds to all the rights therein of a landholder or the landholder inherits

or otherwise acquires the same.

(vii) when he sells or makes a gift thereof 

(viii) if he migrates from India to a foreign -country without obtaining a valid passport or without

lawful authority:

(ix) if the allotment of land is cancelled or the land is ordered to be resumed under the provisions of

Rajasthan Land Revenue-Act. 1956

Failures are Stepping Stone to Success

Man acts with a view to achieving his goal in whatever field he is engaged. Obviously, he dreams of success and he will never bargain for less than success. But, success is not always the result. All his efforts may end in fiasco.The lesser men would give in to the pressure and throw their hat in. But, a man of fortitude will persevere realising that his failure is a stepping stone to success in future. He learns from his failure. The failure provides man an opportunity to analyse its cause. Having realised his shortcomings, he will adopt a prudent course on the way to success. The ascent to Mount Everest and landing on the Moon are the rare achievements of the recent past. Do we think that the only first attempt brought success to the adventurers? One shudders to think of the amount of failure they must have encountered to be at last on the top of the world. It is the indefatigable spirit that ultimately leads to success.
