The chairperson and members are appointed by the Governor on the recommendations of a committee consisting of the chief minister as its head, the speaker of the Legislative Assembly, the state home.minister and the leader of the opposition in the Legislative Assembly.
| Tenure : 3 years or age of 70 years whichever is earlier. Removal: only by the PRESIDENT : if adjudged insolvent, engages in paid employment outside office duties, is unfit due to mental or physical infirmity, declared of unsound mind by a competent court, or convicted and sentenced to imprisonment for an offence. Additionally, on grounds of proved misbehavior or incapacity. Reappointment : eligible for reappointment but cannot be employed further under the state or Central government after their tenure Salary and Allowances : Determined by the state government. |
RSHRC: Established under Section 21 of the Protection of Human Rights Act, 1993. Functional since March 2000.
Watchdog of human rights:
- Inquiries: Investigate any violation of human rights or negligence in preventing such violations by a public servant. (suo motu, petitions, or court orders). Ex. RSHRC issued a notice to Kota SP after a patient died due to a hospital oxygen mask catching fire.
- Court Intervention: Participates in court cases related to human rights violations.
- Jail Visits: Inspects jails and detention centers, checks inmate living conditions, and makes recommendations.
- Review of Safeguards: Reviews and suggests improvements in constitutional and other legal safeguards for the protection of human rights.
- Addressing Issues: Looks into factors (terrorism, etc.) that hinder human rights.
- Research: Promotes and conducts human rights research. (e.g., Published a report on silicosis highlighting government unpreparedness).
- Awareness : Spreads human rights literacy and awareness.
- NGO Support: Aids NGOs working in human rights.
- Additional Functions: Undertakes other tasks to promote and protect human rights.
